U.S. Tariffs Update and Art-Related Exemptions

Following the latest announcement from the U.S. government, we would like to share important updates regarding new import tariffs that may affect your shipments, as well as key exemptions relevant to artworks.

Key Dates

• April 5, 2025: A general 10% tariff will apply to all goods imported into the United States.
• April 9, 2025: Additional tariffs will be imposed on imports from specific countries. For details, please consult the official White House document.

Exemptions to Note

Some items may be exempt under 50 U.S.C. & 1702(b), which includes:

• Artworks categorised under Chapter 97 of the HTS (e.g., paintings, prints, sculptures).
• Printed materials and photographs under Chapter 49 of the HTS.

Important Considerations

• Antiquities, design, and furniture pieces may not fall under these exemptions and could be subject to added duties.
• While current guidance suggests artworks are exempt, we advise caution until these rules are officially confirmed. Further regulatory changes are possible.

Our Recommendations

1. Ensure Accurate Documentation
   Tariffs depend on the country of origin—defined as the location where the artwork was created. Clearly noting this in shipping paperwork helps prevent customs delays or misclassification.
2. Notify Recipients of DDP Shipments
   For Delivered Duty Paid (DDP) shipments already on route, inform recipients that additional duties may apply once tariffs are enforced.

As the situation evolves, retaliatory measures from other nations may increase complexity. We expect tariff rates to fluctuate in the coming weeks, particularly in response to EU counteractions. We are closely monitoring developments and will keep you informed.
